Terms of Service

These Terms of Service ("Terms") govern your use of CartPing, a Shopify application provided by Robo Solutions ("we," "us," or "our"). By installing or using CartPing, you agree to these Terms.

1. Description of Service

CartPing is a Shopify application that automatically sends SMS text messages to customers who abandon their shopping carts on your Shopify store. The service is designed to help merchants recover lost sales by reminding customers to complete their purchases.

2. Eligibility

You must have a valid Shopify store and an active CartPing subscription to use the service. By using CartPing, you represent that you have the authority to bind your business to these Terms.

3. Merchant Responsibilities

As a merchant using CartPing, you are solely responsible for:

• Obtaining proper consent from your customers to receive SMS marketing messages, as required by applicable laws including the Telephone Consumer Protection Act (TCPA) and any other applicable regulations in your jurisdiction
• Ensuring your use of CartPing complies with all applicable laws and regulations
• The content of messages sent through CartPing using your custom templates
• Providing accurate business and contact information
• Maintaining appropriate opt-in records for your customers

4. Prohibited Uses

You may not use CartPing to:

• Send messages to individuals who have not consented to receive SMS communications from your business
• Send spam, harassing, deceptive, or illegal messages
• Violate Twilio's Acceptable Use Policy or any carrier's messaging policies
• Violate any applicable laws or regulations, including the TCPA, CAN-SPAM, or GDPR
• Impersonate another business or person
• Interfere with the service or attempt to gain unauthorized access

5. Subscription and Billing

CartPing is billed at $29 per month through Shopify's billing system. Your subscription begins after a 14-day free trial. Billing is handled entirely by Shopify — we do not store your payment information. You may cancel your subscription at any time through your Shopify admin.

We reserve the right to change our pricing with reasonable notice. Continued use of CartPing after a price change constitutes acceptance of the new pricing.

6. Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. We are not liable for service interruptions, SMS delivery failures, or delays caused by third-party providers (including Twilio or mobile carriers).

7. Limitation of Liability

To the maximum extent permitted by law, Robo Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of CartPing, including but not limited to lost revenue, lost profits, or loss of data. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Robo Solutions and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of CartPing, your violation of these Terms, or your violation of any third-party rights or applicable laws.

9. Termination

We may suspend or terminate your access to CartPing at any time if you violate these Terms or applicable laws, or if we have reason to believe your use is causing harm. You may terminate your subscription at any time by uninstalling the app from your Shopify store.

10. Disclaimer of Warranties

CartPing is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that SMS messages will be delivered successfully to all recipients.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Shopify admin. Continued use of CartPing after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
